1. Agreement
1.1 Agreement between parties
These Terms of Service are an agreement between MarionetteOps.com, also referred to as "MarionetteOps", "we", "us", or "our", and the person or organization that accesses the website, creates an account, installs an agent, or uses any MarionetteOps service, also referred to as "you" or "the user".
By using MarionetteOps, you accept these terms. If you do not agree with these terms, you may not use the website, API, agents, dashboards, alerting tools, status pages, or related services.
If you use MarionetteOps on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. License to Use the Website
2.1 Limited license
Unless otherwise stated, MarionetteOps owns or licenses the intellectual property rights in the website, application interface, documentation, brand assets, and other materials we provide.
You may view and use the website and service for your own legitimate monitoring and operational purposes, subject to these terms.
You must not republish, sell, rent, sublicense, duplicate, modify, frame, scrape, or commercially exploit any MarionetteOps material except where the service intentionally makes content public, such as a public status page or public uptime report that you control.
3. Acceptable Use Policy
3.1 Acceptable use
You may not use MarionetteOps in a way that damages, disables, overloads, or impairs the website, API, monitoring infrastructure, mail systems, notification integrations, or other users' access to the service.
You may not use MarionetteOps for unlawful, fraudulent, abusive, deceptive, or harmful activity. You may not upload, link to, transmit, or distribute malware, spyware, credential harvesters, destructive code, or other malicious software through the service.
You may not conduct automated data collection against MarionetteOps without our written permission, including scraping, data mining, data extraction, harvesting, iframe embedding, or similar activity.
You may not use MarionetteOps to send unsolicited commercial messages, test spam delivery, probe third-party systems without authorization, or create monitoring traffic that you do not have permission to send.
3.2 Monitoring targets
You are responsible for ensuring that every server, website, endpoint, domain, certificate, status page, and notification destination you add to MarionetteOps is owned by you, managed by you, or authorized for monitoring by you.
We may suspend or remove monitors that appear to target unrelated third parties, abusive destinations, deceptive infrastructure, or systems where monitoring would create operational, legal, or security risk.
4. Accounts and Access
4.1 Restricted access
Some areas of MarionetteOps require an account, password, API key, session, pairing token, or other credential. You are responsible for keeping those credentials confidential and for all activity that occurs under your account.
We may restrict, suspend, or disable access to any account, organization, API key, monitor, agent, or status page if we believe it is necessary to protect the service, enforce these terms, respond to security concerns, or comply with law.
4.2 Account limits
You may not create or manage multiple free accounts for the same person, team, business, or organization without our written permission. Free accounts are intended to let distinct users and organizations evaluate and operate within the published free-plan limits.
Plan limits, feature limits, check intervals, alerting quotas, retention periods, and other service limits may vary by account type and may change over time.
4.3 Inactivity
For free accounts, we may disable, suspend, delete, or archive inactive accounts and recurring monitoring tasks, including uptime monitors, server agents, cron monitors, notification settings, and status pages. When practical, we may notify the account owner before taking action.
5. Monitoring Services
5.1 Service data
MarionetteOps receives and processes monitoring data that may include endpoint URLs, hostnames, IP addresses, status codes, timing data, error messages, SSL and domain metadata, system metrics, process information, notification preferences, and agent reports.
You are responsible for the data you send to MarionetteOps and for avoiding secrets, personal data, regulated data, or confidential customer data in monitor names, labels, URLs, headers, status messages, reports, and notification content unless your use is lawful and appropriate.
5.2 Alerts and status pages
Alerts, reports, and status pages are provided to help you operate your systems, but they are not a substitute for your own incident response, backups, redundancy, security controls, or business continuity planning.
Notification delivery depends on third-party services such as email providers, webhooks, chat platforms, push services, carriers, and your own infrastructure. We do not guarantee that any notification will be delivered, delivered on time, or received by the intended person.
6. Billing
6.1 Payments
Paid services are billed in advance according to the plan, billing cycle, and pricing shown during checkout or in your account. Unless stated otherwise, payments are made in United States dollars.
We may suspend or limit paid services if payment is overdue, if payment fails, or if billing information is inaccurate or unavailable.
6.2 Trials, cancellations, and refunds
Free plans and trial periods are provided so you can evaluate MarionetteOps before purchasing. Unless a separate written agreement says otherwise, refunds are discretionary and may be approved or denied based on the circumstances of the request.
You are responsible for canceling paid services you no longer want before the next renewal date.
6.3 Disputes and chargebacks
Please contact support before opening a billing dispute so we have a chance to investigate and resolve the issue. Fraudulent payments, unauthorized payment use, or abusive chargebacks may result in suspension or termination of accounts and services.
7. Disclaimers and Liability
7.1 Disclaimer
MarionetteOps is provided on an "as is" and "as available" basis. We do not promise that the website, API, agents, monitors, reports, alerts, or status pages will be uninterrupted, error-free, complete, accurate, secure, or available at all times.
We may perform maintenance, modify features, change limits, update integrations, or discontinue parts of the service when needed.
7.2 Limitation of liability
To the fullest extent permitted by law, MarionetteOps will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, customers, goodwill, data, systems, contracts, business opportunities, or anticipated savings.
These limits apply even if MarionetteOps has been advised of the possibility of such losses.
8. Breaches of These Terms
If you breach these terms, we may take any action we reasonably consider appropriate, including warning you, limiting features, suspending monitors, disabling agents, deleting public pages, blocking traffic, suspending or terminating accounts, contacting affected providers, or pursuing legal remedies.
9. General Terms
9.1 Changes to these terms
We may revise these terms from time to time. Updated terms apply when posted on this page, unless a later effective date is stated. Please review this page periodically so you remain familiar with the current terms.
9.2 Assignment
We may transfer, subcontract, or otherwise deal with our rights and obligations under these terms without your consent. You may not transfer your rights or obligations under these terms without our written permission.
9.3 Severability
If any part of these terms is found to be unlawful or unenforceable, the remaining parts will continue in effect. If an unenforceable part would become enforceable by removing a limited portion, that portion will be treated as removed.
9.4 Entire agreement
These terms, together with any policies or agreements expressly incorporated into them, are the entire agreement between you and MarionetteOps regarding your use of the website and services.
